Are you a manufacturer, importer or distributor of batteries? New obligations apply to you since August!
From August 2024, producers placing batteries on the market for the first time are obligated to draw up a declaration of conformity. The corresponding CE marking must be affixed before the first commissioning of the batteries, at the latest. For electric vehicle batteries, rechargeable industrial batteries with a capacity > 2 kWh, batteries for light transport (LV batteries) and starter batteries with recycled content, extensive conformity assessment procedures must be implemented, requiring the involvement of a notified body. The identification number of the notified body has then to be taken into account when doing the artwork for the marking of the battery. For device batteries, starter batteries without recycled content and certain industrial batteries, a conformity assessment procedure with internal production control is sufficient.
Distributors and importers must ensure that the producer has correctly implemented the above obligations and that the required CE mark is affixed to the battery before placing or making available the batteries on the market.
In addition, producers and importers must label the battery with their contact details. The battery itself must also be clearly identifiable by a number or similar mark. In the event of a (necessary) product recall, such recall will refer to all products marked with the corresponding identifier!
In the coming months and years, a large number of implementing regulations and delegated acts are expected, specifying future obligations arising from the Battery Regulation. It is therefore advisable to closely monitor further developments in order to be able to respond to additional requirements in a timely manner.
